1. Interpretation & Definitions

Interpretation: Words with capitalized initials have specific meanings defined in this section. These definitions apply whether the terms appear in singular or plural form.

Definitions:

• Affiliate: any entity that controls, is controlled by, or is under common control with a party.
• Country: California, United States.
• Company: TECHNET PARTNERS, Inc.
• Device: any device capable of accessing the Service.
• Service: the Website.
• Website: www.technetpartners.com.
• You: the individual or legal entity accessing or using the Service.

2. Acknowledgment

By accessing or using the Service, You agree to be bound by these Terms & Conditions. If You disagree with any part of the Terms, You must not use the Service. You must be at least 18 years old to use the Service.

Agreement to these general Terms does not, by itself, constitute consent to receive SMS messages. Consent to participate in the TechNet Partners SMS Program must be provided separately and affirmatively through the SMS Opt-in Form or another documented opt-in method.

3. SMS Messaging Terms

TechNet Partners operates a recurring SMS program for independent technicians and contractors who voluntarily opt in to receive contractor opportunity and dispatch communications.

Messages may include nearby contractor job opportunities, job numbers, service locations, requested dates and arrival times, required skills or tools, compensation information when applicable, secure response links, application updates, assignment confirmations, scheduling reminders, responses to technician questions, and notifications that an opportunity has been filled.

Consent: Participation in the SMS program is optional. You consent to receive SMS messages only when You affirmatively select the optional SMS consent checkbox on the SMS Opt-in Form or send a supported opt-in keyword to the TechNet Partners messaging number. The checkbox is not selected by default and is separate from acceptance of these Terms.

Consent to receive SMS messages is not a condition of registering as a contractor, being considered for contract work, purchasing goods or services, applying for an opportunity, or maintaining a contractor relationship with TechNet Partners. If You do not provide SMS consent, You may still submit the registration form and may be contacted through other lawful communication methods.

• Message frequency: Message frequency varies and may be up to 10 messages per week.
• Charges: Message and data rates may apply.
• Opt out: Reply STOP, STOPALL, UNSUBSCRIBE, CANCEL, END, or QUIT at any time. You may receive one final confirmation message.
• Renew consent: Submit the SMS Opt-in Form again or text START, UNSTOP, or SUBSCRIBE.
• Help: Reply HELP or INFO, call (760) 683-8393, or email sms@technetpartners.com.
• Mobile carriers are not responsible for delayed or undelivered messages.

Mobile information and SMS consent records are handled under our Privacy Policy. Mobile telephone numbers and SMS consent information will not be sold, rented, released, or shared with third parties or affiliates for marketing or promotional purposes.

4. Links to Third-Party Websites

Our Service may contain links to external websites or services not operated by the Company. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party sites or services.

5. Termination

We may suspend or terminate Your access to the Service immediately, without prior notice or liability, for any reason, including if You breach these Terms.

6. Limitation of Liability

The Company’s total liability shall not exceed $100 or the total amount You paid for the Service (whichever is less). In no event shall the Company be liable for indirect, incidental, special, consequential, or punitive damages.

7. “AS IS” & “AS AVAILABLE” Disclaimer

The Service is provided “AS IS” and “AS AVAILABLE” without warranties of any kind, express or implied. The Company does not guarantee that the Service will be uninterrupted, secure, or error-free.

8. Governing Law

These Terms are governed by the laws of California, United States, without regard to conflict of law principles.

9. Dispute Resolution

We encourage You to first attempt to resolve disputes informally by contacting the Company. If a resolution cannot be reached, disputes will be handled under California law.

10. Refund Policy

All sales are final. If you have concerns after services have been rendered, please contact us directly.

11. For EU Users

If You are a European Union consumer, You will benefit from any mandatory provisions of the law of your country of residence.

12. U.S. Legal Compliance

You represent and warrant that You are not located in a country subject to a U.S. government embargo or on any U.S. restricted party list.

13. Severability & Waiver

Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

Waiver: Failure to enforce any right under these Terms shall not constitute a waiver of that right.

14. Translation

In the event of any discrepancy between translations, the English version of these Terms will prevail.

15. Changes to These Terms

We may update these Terms periodically. The updated version will be posted on this page with a revised effective date. Changes will not retroactively expand the scope of Your SMS consent. If a material change requires new SMS consent, TechNet Partners will request separate affirmative consent.

16. SMS Opt-In

The public TechNet Partners SMS consent form is available at https://technetpartners.com/sms-opt-in/. The SMS checkbox is optional, singular, and unchecked by default. The form may be submitted without consenting to SMS.
